Medical Fitness Declaration

I declare that I am physically fit and able to participate in the Introduction to Longsword Workshop, a physical activity involving the handling of training swords/weapons, partnered drills, and physical exertion. I confirm that I am not aware of any medical condition, injury, illness, pregnancy, or other circumstance that would make my participation unsafe for me or others. I understand it is my responsibility to disclose any relevant condition to the organisers before participating, and to stop and seek assistance if I feel unwell or unsafe at any time.

Acknowledgment of Risks

I, the undersigned participant, acknowledge that the activity (the “Introduction to Longsword Workshop”) I am about to participate in carries inherent risks, dangers, and hazards that may result in injury, illness, death, or damage to property. These risks include, but are not limited to:

Physical exertion and potential overexertion.
The handling and use of longswords, training swords, and other weapons or equipment, including the risk of impact, cuts, bruising, strains, or other injury.
Contact with other participants, objects, weapons, or environmental conditions.
Accidents due to unforeseen circumstances or natural elements.
Equipment failure or malfunction.
Failure to wear the required eye protection (safety glasses, e.g. from Bunnings, or a fencing mask), which every participant must bring and wear during all drills.
The negligence of others, including organisers, instructors, volunteers, or other participants.

I understand that these risks cannot be entirely eliminated, and I voluntarily assume all risks, both known and unknown, associated with my participation in the Activity.

Release and Waiver of Claims

In consideration of being permitted to participate in the Activity, I hereby agree to release, waive, discharge, and covenant not to sue Fight Creative, Chan Griffin, the workshop instructor Alex Roberson and Sword Fighter Historical Fencing, and the venue operator Aerial Angels Cirque Central and their officers, directors, employees, agents, volunteers, and successors (collectively, “the Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Activity, or while in, on, or upon the premises where the Activity is being conducted, to the maximum extent permitted by law.

Indemnification

I further agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including legal fees, that they may incur due to my participation in the Activity, whether caused by the negligence of the Released Parties or otherwise. This includes, but is not limited to, any claims, demands, or actions brought by third parties arising from my conduct during the Activity.

Medical Treatment

I authorise the Released Parties to obtain medical care for me in the event of an emergency during the Activity, if, in their sole discretion, such care is deemed necessary. I understand that I am solely responsible for any and all costs associated with such medical care.

Severability

I agree that if any portion of this Waiver and Release of Liability is found to be unenforceable, the remaining portions shall remain in full force and effect.

Governing Law

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of Queensland, Australia.

Media Rights

I grant to Fight Creative and Chan Griffin and their representatives the right to take photographs, videos, or other recordings of me in connection with the Activity, and to use and publish these recordings in any and all media, without compensation, for promotional, marketing, or other purposes — unless I indicate in the form below that I do not consent. I waive any right to inspect or approve the finished product.

Acknowledgment of Understanding

I have read this Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

If the participant is under 18, a parent or legal guardian must complete and sign this form on their behalf.
